Work accident compensation claim – Slipping accident at work
Joanne’s client in this entirely avoidable accident at work, had slipped down some stairs, which were wet due to rainwater. The water had leaked through the roof and the drains were also blocked. As he fell, Joanne’s client suffered a head injury, a shoulder injury and landed heavily on his knees. He has been left with considerable pain and discomfort, and limited mobility in his shoulder and knees.
Joanne fought this accident compensation claim on the basis that the defendant had breached The Workplace (Health, Safety and Welfare) Regulations 1992, (amongst others) by not providing a safe working environment for his employees.
The defendant, his employer, admitted liability for her client’s accident but refused to negotiate an acceptable settlement. Joanne was forced to issue court proceedings and before trial was able to negotiate over £20,000 in compensation for his injuries.
Public liability compensation claim – Occupier’s Liability Act
Joanne brought this claim for accident compensation when her client was injured whilst an inpatient in hospital. She had put her hand on the sill of an open window when the sash window came down suddenly, causing an injury to her hand.
Joanne argued that the operators of the hospital had breached their duty under the Occupiers' Liability Act 1957, to ensure the safety of her client whilst she was on their premises. They had failed to ensure the safe condition of the window by failing to implement or carry out an adequate system of inspection and maintenance.
Her client had suffered an injury to her thumb, leaving her with limited use. The other side’s insurers refused to negotiate a settlement and Joanne was forced to issue court proceedings. However, prior to the trial date, she was able to negotiate £10,000 in accident compensation for her client.
