Martyn is a qualified solicitor with many years' experience, and has successfully represented hundreds of clients seeking compensation across the full range of personal injury claims.

However, his specialist area of expertise has developed from his extensive knowledge of compensation claims for overseas accidents, and Martyn is our National Supervisor for Overseas Accident claims.

Here is just a small sample of the many successful compensation claims with which Martyn has been involved.

Work accident compensation claim – Work Equipment & manual handling injury

Martyn represented a client who was forced to give up a professional career following a manual handling accident at work. A paramedic, Martyn’s client was injured when responding to a serious domestic incident. A bag holding vital equipment caught on the doorframe, pulling his shoulder and arm. The abrupt halt to his progress caused his client to fall backwards on to his arm and shoulder.

Early the next morning, he was in such pain that he reported sick and attended the local hospital where he was x-rayed. This revealed a fracture of the scapula. Initially, Martyn’s client was given conservative treatment but when his condition deteriorated even after physiotherapy, he sought the advice of a consultant and an MRI scan revealed that there was an injury to discs in his neck. Unable to return to work, Martyn’s client was retired on the grounds of ill-health.

There had been repeated complaints regarding the use of this particular bag, and requests to replace it with one more suitable for the work involved. Martyn was therefore able to prove that his client’s employer had breached the Management of Health and Safety at work Regulations 1999 by not providing a safe working environment. There were also breaches to the Provision and Use of Work Equipment Regulations 1998 as no risk assessment had been carried out to review the use of the bag in question.

Martyn was able to secure a six-figure sum in work accident compensation for his client, part of which was in recognition of loss of congenial earnings.

Holiday accident compensation claim – Slipping accident abroad

Martyn represented a client who had initially asked another solicitor to represent her in bringing a claim for holiday accident compensation. The claim was in respect of a slipping accident on an external staircase during her holiday in Greece.

Martyn’s extensive experience in dealing with claims for accidents abroad allowed him to navigate through the complex nature of this case, securing evidence of the breach of local standard that applied to such staircases in Greece.  Based on that evidence, he was able to successfully conclude a claim for compensation against the UK Tour operator under the Package Travel, Package Holidays and Package Tour Regulations 1992.

Initially, the defendant had denied liability and Martyn was forced to issue court proceedings. However, before the trial date he was able to negotiate almost £7,000 in holiday accident compensation for his client’s injuries, which included a broken ankle that required surgery. She was unable to return to work for several months and part of the sum was in compensation for loss of earnings.
