Work accident compensation claim – Tripping accident
Rhicha’s client in this work accident compensation claim had injured her back when she tripped and fell on loose cardboard. The cardboard had been put in place to cover temporary steps, which had been installed during a refurbishment project at her workplace.
The cardboard had been secured by adhesive tape but was not sufficiently secure, allowing some to become loose and present a tripping hazard.
Rhicha’s client had put out her hand to grab the handrail in order to break her fall, but felt a sharp shooting pain in her back as she fell. She suffered an injury to her back and was unable to return to work for some time.
Rhicha fought this claim for work accident compensation on the grounds that the employer had breached the Workplace (Health, Safety and Welfare) Regulations 1992, amongst others, by not ensuring that the traffic routes around the workplace were suitable for the purpose during the refurbishing process. She was able to negotiate an acceptable sum in work accident compensation for her client.
Accident compensation claim – Manual handling injury
A student, the client in this claim for manual handling compensation, was injured in a school accident when she was asked to put away a piece of equipment that had been used by her class during the day. She was not provided with any training in manual handling techniques and no risk assessment had been carried out. Had this been done, it would have been clear that the equipment was too heavy and awkward for the student to be asked to handle alone.
The defendant had breached the duty of care under the Occupier’s Liability legislation by not ensuring the student was safe whilst on their premises. The defendant denied liability and Rhicha was forced to issue court proceedings before being able to successfully negotiate an acceptable sum in accident compensation for her client.
Work accident compensation claim – Manual handling injury
Rhicha’s client in this work accident compensation claim was a member of the emergency services. She was injured as she went to the assistance of members of the public. She suffered severe injuries to her hand and was unable to carry out her physical duties for some time.
Although the client’s accident occurred on private property, the circumstances of the injury could not be attributed to the occupier. Rhicha was therefore unable to bring a claim for compensation under the Occupier’s Liability Act.
However, her client’s employer had failed to provide her with sufficient training in order to manage the circumstances in which she found herself. Rhicha was able to secure work accident compensation of several thousand pounds for her client. The client’s employers were reluctant to admit liability and Rhicha was forced to issue court proceedings before they accepted their responsibility and agreed to negotiate the sum secured.
