Work accident compensation claim – Manual handling injury
Robert’s client in this claim for accident compensation was injured when she tried to release a trolley in order to access another one behind. The trolleys are retained by a catch that is normally released by pushing a button, allowing the trolley to be pulled forward. On the day of her accident at work, the catch failed to release and in trying to force the trolley out of its holding position, Robert’s client felt an immediate pain in her upper arm and neck.
Following an x-ray and other investigations, Robert’s client was diagnosed as suffering a hernia on her disc. Advised against surgery, his client has suffered months of pain and was unable to return to work for many months.
After rejecting several unacceptable offers, Robert was forced to issue court proceedings. However, prior to the trial date, he was able to negotiate a sum of several thousand pounds for his client.
Work accident compensation claim – Manual handling injury
This client suffered a severe back injury when he was moving a large drum during the course of his work. Although it was considered a job for two men, our client was habitually required to move the drum on his own as other duties frequently meant that his colleague was unavailable. The drum weighed in excess of 50 lbs and apart from its weight, it was necessary to carry it up a flight of steps to another level.
On the day of his work accident, Robert’s client felt a pop in his lower back and had to stop and rest before continuing the move. However, the next day his back was stiff and the pain became increasingly severe. He subsequently underwent an MRI scan and other procedures to try to reduce the pain.
He had not been provided with any manual handling training and his employer had been negligent not only in providing this, but negligent in failing to ensure that two people were available at all times to carry out this two-man operation.
Robert was forced to issue court proceedings but before trial was able to negotiate a substantial sum in manual handling compensation.
Occupational disease compensation claim – Noise induced deafness
Robert’s client was a maintenance engineer working in an area where several printing presses were running constantly. He would work on each press whilst the others around him continued to run. He had worked for the defendant for many years but had only been provided with ear defenders for a few years prior to his hearing deterioration.
Prior to his being provided with ear defenders he had been given no warning of the risks to his hearing, nor provided with training about minimising the risks involved.
He has suffered a substantial loss of hearing in both ears and finds it difficult to follow conversations if there is background noise, even if the person is standing right in front of him. He also has to listen to the TV with the sound much higher than normal.
Robert brought this claim for industrial disease compensation as a result of the employer’s breach of the Factories Act 1961 and The Noise at Work Regulations 1989. They had failed to supply adequate noise reducing measures or a safe place to work, amongst many other failures. He was forced to issue court proceedings and was then able to negotiate a settlement in occupational deafness compensation in excess of £10,000.
