Work accident compensation claim – Needlestick injury

Sarah’s client in this work accident compensation claim was injured when he picked up a rubbish bag to dispose of it. Unknown to him, a needle was sticking out of the bag and as he lifted the bag, the needle entered his arm.

Initially quite painful, the wound bled for some time after the work accident, and led to considerable stress and anxiety. The nature of the injury meant that Sarah’s client had to undergo immediate blood tests to confirm whether or not he had contracted any disease from this injury, tests which would need to be repeated over a twelve-month period.

All organisations have a duty of care to protect their employees from injuries such as this. Strict guidelines are in place to separate hazardous rubbish and to make the hazard clearly visible to employees. The needle should have been placed in a special container, known as a sharps box, and not a plastic bag.

The defendant was in breach of several regulations, including the Workplace (Health, Safety & Welfare) Regulations. They had failed to ensure that not only was a sharps box available but that all employees were advised of its existence and purpose. In addition, they had failed to make sure a robust system was in place to ensure that these guidelines were adhered to by all employees.

By utilising her keen negotiating skills, Sarah was able to secure a satisfactory sum in work accident compensation for her client.

Work accident compensation claim - Manual handling injury

Sarah’s client in this claim for work accident compensation was a Health Care Support Worker. She was injured during the course of her work caring for patients at a hospital. At the time of the work accident, she was assisting a Staff Nurse to move a large patient from a chair to a bed.

The patient was asked to stand and turn whilst supported by the client and her colleague. Suddenly and without warning, the patient grabbed Sarah’s client’s arm and fell onto the bed, pulling our client with her, causing her to suffer muscular damage to her arm, shoulder and neck.

Sarah fought this claim for work accident compensation on the basis that the Trust had failed to advise Sarah’s client that the patient assessment stated that a hoist would be required when moving this patient, and had failed to ensure sufficient staff were on duty to manage the needs of the patients. These failures meant they had breached the Manual Handling Operations Regulations 1992, which includes the movement of people in its guidance.

The Trust refused to negotiate a settlement until Sarah issued court proceedings. Shortly before the trial, she was able to negotiate several thousand pounds in work accident compensation.
