Sue Boswell - Personal injury solicitor

Derby solicitor for occupational disease and accident compensation claims

Sue is a Derby solicitor, based in our local office there, and has practiced as an accident compensation solicitor for 15 years, specialising in personal injury and occupational disease law. During this time she has gained extensive, in-depth knowledge of all types of personal injury.

The list of her successful accident compensation cases includes accidents at work, road traffic accidents, slips, trips and falls, (at work or a street accident), accident compensation claims involving defective products or premises. These have ranged from burns caused by incorrectly applied beauty products, to extremely complex accident compensation claims of high value and serious injuries resulting in lost limbs or where the client becomes completely incapacitated, wheelchair bound, or sadly lost their life.

Her experience of work accident compensation claims ranges from manual handling injuries, injuries whilst working at height, being hit by flying objects or moving vehicles, and often serious injuries caused because of the negligence of employers in ensuring machinery and equipment is correctly maintained and safe to use.

Two particular areas of interest for Sue has been accident compensation claims involving animals and sports injuries. She has a special interest in Horse Law and is a member of the Equine Lawyers Society.

In the area of occupational disease, Sue has proven her ability through successfully acting for widows and the families of asbestosis victims, securing the compensation to which they are rightly entitled. She has also fought claims for clients who have respiratory difficulties that have debilitated them so that they cannot continue working; and who are severely limited in how far they can walk. She has successfully acted for many victims who suffer from noise induced hearing loss, hand arm vibration syndrome and occupational dermatitis. Sue specialises in hearing loss claims.

Many of Sue’s clients are traumatised by the accident, which causes them to have difficulties coming to terms with the trauma they were directly involved in. Sue treats all her clients with the utmost sensitivity to avoid making the claim process any more stressful at a difficult time for them, whilst ensuring she obtains all the details she needs to successfully proceed with their accident compensation claim.

Sue is a member of the Personal Injury Panel accredited by the Law Society as a specialist in Personal Injury Law.

Successful accident compensation and occupational disease claims

Here is just a small sample of the many successful compensation claims with which Sue has been involved.

Occupational disease compensation claim – Exposure to harmful substances (coolant)

Sue was asked to represent a client who had worked for the same company for 10 years when he suddenly began to feel generally unwell. His symptoms included feeling snuffly, coughing and lethargic. These subsequently developed into breathing difficulties.

When he thought about what had changed, he was unable to think of anything other than at work, where trials of a new coolant were underway.

Sue investigated and was able to prove that there was a direct link between contaminates in the coolant and her client’s symptoms. His employer should have carried out risk assessments to ensure the new coolant would not cause irritation to his staff. He should also have warned them if there were any potential hazards, giving them the opportunity to obtain respiratory equipment, or abstain from the trials until the product was proven to be safe.

Sue was able to negotiate occupational disease compensation for this client, much to his satisfaction, having first issued court proceedings but settling shortly before trial.

Work accident compensation claim – Construction site accident

Sue’s client in this work accident compensation claim was seriously injured when part of a staircase collapsed on him whilst he was working on a building site. The HSE (Health and Safety Executive) investigated and Sue was involved in assisting them to bring a successful prosecution.

She then went on to successfully win work accident compensation for her client as well as obtaining rehabilitation for him which went a long way to aid a very long and painful recovery.

The Construction (Health, Safety & Welfare) Regulations 1996, the Working at Height Regulations 2005, the Management of Health & Safety at Work Regulations 1999, all applied to this compensation claim.
