In order to win a claim for asbestos-related compensation, you need expert legal advice from lawyers who are experienced in this complex area of the legal system. The nature of the injury, and the need to prove exposure to asbestos by a company that can be traced (or was insured) often many decades ago, makes it imperative that the case is dealt with by experienced, sympathetic, specialist lawyers. Our specialist asbestos teams, have that experience, and have been successful in thousands of asbestos-related compensation claims.
Clear Answers has access to the appropriate medical experts to report on the effects of your condition and its cause, as well as access to leading engineering experts who will provide evidence to help establish whether whoever was responsible for exposing you to asbestos was in breach of their legal duty of care.

Asbestosis is a disease that develops after prolonged or heavy doses of exposure to asbestos dust. This asbestos-related disease can take up to 25 or more years to develop. When the asbestos fibres are inhaled, they enter the lung and, over time, cause scarring in the form of fibrosis that can reduce the effectiveness of the lungs to transfer oxygen into the blood. Once the scaring process has taken hold, the disease may progress. The full medical term for asbestosis is pulmonary interstitial fibrosis.
Symptoms of asbestosis are breathlessness, a dry cough and progressive shortness of breath as the scaring increases. Moderate or severe asbestosis can also cause an abnormality of the finger tips known as “clubbing”. The long-term effect may also increase pressure on the heart and, in severe cases, be a contributory factor in heart failure.
There is no cure for asbestosis and its presence may double the risk of developing lung cancer.

The normal time limit for commencing a personal injury compensation claim for any asbestos-related injury is three years from the date that you had reason to believe that your condition was significant and was due to asbestos exposure. However, because the development of such diseases may occur many years after the exposure to asbestos fibres (often after 30 to 50 years or more), the 3 year time limit for these types of injury begins from the date you became aware of the diagnosis of the disease.
In the unfortunate situation where the victim has died, the family may bring a personal injury compensation claim within three years of the victim’s death. Because of the long latency period for the development of asbestos-related diseases, claims will be brought decades after the initial exposure to asbestos, often making the investigation of the claim seem complex and daunting.
However, Clear Answers specialist lawyers are familiar with this type of claim and have the expertise to investigate claims quickly and give clear advice about the prospects of success.
Clear Answers’ specialist asbestosis lawyers understand the sensitivity that surrounds these types of cases. We have the expertise to deal with your claim as quickly as possible, and wherever possible to obtain the compensation to which you are entitled. We have even been successful in some cases of obtaining personal injury compensation even though the three-year time limit had expired.
It is important that you seek specialist advice without delay from lawyers who are experienced in dealing with asbestos-related compensation claims, even if you are not sure when the three-year limit will expire.

In order to pursue a claim for asbestosis injury compensation, Clear Answers’ specialist asbestos lawyers will first establish whether the company responsible for your exposure to asbestos can be found and whether there is any insurance available. If the company that originally caused your injury is no longer operating, a successor company can sometimes be found. If the company no longer exists, it is often possible to pursue the claim if insurers can be traced. Clear Answers' specialist asbestos lawyers have decades of experience of tracing companies and their insurers in asbestos claims and have a large database of archive information.
Because of the length of time that has elapsed between the exposure to asbestos and the diagnosis of an asbestos-related disease, the process of identifying the responsible company or their insurers requires expert advice, which Clear Answers' specialist asbestos lawyers can provide free of charge.
Having established that there is a company or an insurer to pursue against, Clear Answers’ specialist asbestos-related disease lawyers will commence the compensation claim process, starting by discussing the history of asbestos exposure with you and then obtaining a detailed medical report. This will be obtained from an expert in the field of asbestos-related disease. The medical expert will be asked to give an opinion about the diagnosis of your condition. If the medical expert confirms the diagnosis of an asbestos-related injury for which compensation can be claimed, then the claim can proceed.
