Below is just a small sample of successful work accident compensation claims that Dianne has won.

Work accident compensation claim – Defective equipment

In his duties as a pipe fitter / installation engineer, Dianne’s client in this claim for work accident compensation was familiar with the use of a nitrogen cylinder and a nitrogen gauge. At the time of the work accident, he was using these pieces of equipment to remove debris from the floor of his company van.

Having taken the usual precautions in positioning the cylinder prior to use, and attaching the gauge, Dianne’s client realised that there was no pressure on the gauge. As he tried to increase the pressure, the gauge suddenly exploded and the covering glass shattered onto his face, tearing the whole area round his eye and entering his eye, causing bleeding and lacerations.

Despite extensive surgery, Dianne’s client was advised that he had permanently lost the sight in the affected eye which was removed and replaced with a prosthetic. Later investigations revealed that the gauge had been known to be defective before it was placed on his van.

Dianne was forced to issue court proceedings when the defendant continued to deny liability for her client’s work accident. However, shortly before the trial and with the defendants still maintaining a denial of liability Dianne was able to negotiate a significant settlement of many thousands of pounds.

Work accident compensation claim – Manual handling injury

This client was injured during the course of his duties as a fire fighter. The brigade had previously attended a fire at a derelict property and identified propane and butane cylinders present on the site. On that occasion, the fire was quickly brought under control and action was started to identify the owners of the property in order to issue instructions to remove the cylinders.

Some time later, Dianne’s client attended another incident at the same derelict property. The fire on this occasion was more severe and during a routine recognisance walk around the building, he noted that several of the cylinders were still present and were close enough to the fire to present an immediate danger of explosion.

Having radioed for assistance, which was not available, Dianne’s client decided to move the cylinders to remove this serious hazard. As he did so, he stumbled on uneven ground and experienced severe pain in his back. Although he initially tried to carry on working, he eventually had to take time off work and undergo physiotherapy and other procedures.

The defendant’s insurers refused to negotiate a settlement and Dianne was forced to issue court proceedings. The case ultimately proceeded to trial and after a hearing lasting over a course of a week the Judge awarded a substantial sum in compensation for her client’s injury and loss of income.

Work accident compensation claim – Manual handling injury

A fire fighter, Dianne’s client in this claim for manual handling compensation, was injured during a drill. This particular drill was to demonstrate to a new watch member, the correct method of separating parts of a vehicle.

Her client and one colleague took the weight of the roof of the car and moved it away from the rest of the car. As they did so, Dianne’s client experienced a sharp pain at the base of his neck. He suffered considerable pain and discomfort for several weeks before being allowed to return to active duty.

Investigations revealed that no specific risk assessment had been carried out for this type of drill. In an operational situation, four fire fighters would have been assigned to this task. Dianne was forced to issue court proceedings when the defendant refused to negotiate an acceptable settlement. The Judge found in favour of her client and he was awarded work accident compensation.
