Successful asbestos compensation claims

Here is just a small sample of the successful asbestos-related claims that Helen has concluded.

Exposure to asbestos – Mesothelioma victim

In the 50’s, 60’s and 70’s Mr Brown was constantly exposed to asbestos when he came across thermal insulation engineers (“laggers”) as he went about his work, and when using facilities such as the canteen that was also frequented by laggers. The laggers were working with asbestos constantly and would generate clouds of dust through their work. They would dust themselves off before entering the canteen, leaving clouds of asbestos dust through which Mr Brown and other employees had to walk.

Throughout this period of exposure, Mr Brown had been employed at various power stations. His work was often in the boiler rooms and he was forced to inhale asbestos dust and fibres when the laggers were cutting asbestos sheets, or removing old, crumbling asbestos lagging from the pipework.

As was typical of victims of mesothelioma, Mr Brown did not develop the disease until many years after his exposure. Helen took up his case and was able to bring it to a successful conclusion whilst Mr Brown was still alive. Sadly, he has since passed away but was enthusiastic in his praise of Helen’s efforts on his behalf, comparing her to a “Jack Russell with a rat – she just wouldn’t let go”.

Helen was forced to issue court proceedings and although the case proceeded, neither of the employers contested the case. Mr Brown was awarded substantial compensation for his pain and suffering with such a devastating disease as mesothelioma.

Asbestos compensation claim – Asbestosis

Helen’s client was exposed to asbestos with a number of different companies during his working life. He moved from job to job, sometimes after only very short periods of time with an employer. He was diagnosed with asbestosis, causing 5% disability and pleural plaques.

Due to a change in the law, Helen’s client was no longer able to claim compensation for pleural plaques, and the claim proceeded on the basis of asbestosis causing a 5% disability alone.

Helen managed to trace many of her client’s former employers, and Court proceedings were issued against 11 defendants. The Defendants argued that asbestosis was not sufficient to cause him what amounted to a disability in law, and that he should be awarded either no compensation or minimal compensation.

The matter proceeded to trial, where the evidence was heard by a Judge in Court. The Judge accepted our arguments that the 5% disability had a significant affect on her client’s ability to carry out his usual tasks of daily living, and awarded him a substantial sum. In addition, the Court allowed him to settle the claim on a “provisional damages” basis, meaning that if he is unfortunate enough to go on to develop a worsening of his asbestosis or another asbestos related disease such as mesothelioma, he can return to the Defendants for further compensation in the future.

This means that Helen’s client and his family are protected into the future, and have the security of knowing that he can come back for further compensation if the worst should happen.
