Successful asbestos-related compensation claims
Here are just a couple of examples of successful asbestos-related claims that John has handled.
Asbestos-related diseases – Mesothelioma compensation claim
John’s client in this claim for mesothelioma compensation had worked in sawmills for most of his working life. Recently retired, he began to experience severe shortness of breath and difficulty carrying out the simplest of daily tasks, including walking short distances and going up even one flight of stairs.
During the late 1960’s and early 1970’s, John’s client had been negligently exposed to asbestos by his employer. He was required to offload large sheets of asbestos from a flatbed truck and later to assist with cutting the sheets to the size required for further use.
As the sheets were offloaded, they were dropped on top of the previous one, and the dust created rose up and forced John’s client to inhale the dry asbestos dust and fibres. He was further exposed during the cutting process. During neither process was he provided with any protective equipment such as masks. He was never warned of the dangers of inhaling asbestos dust, and no method of extraction was provided in his working environment.
John was forced to issue court proceedings as the defendant in this mesothelioma compensation claim strongly contested his client’s evidence, producing several witnesses to defence. However, John was able to negotiate an acceptable sum in compensation shortly before the trial date, although not before he had rejected an initial offer which he felt was not a true reflection of his client’s suffering, or compensation for the loss his client’s family were about to suffer.
Asbestos-related compensation claim – Mesothelioma victim
John’s client in this compensation claim, sadly died before the claim could be completed. Only in his 50’s, he left a wife and two teenage children. Whilst they are naturally devastated at their loss, and would prefer to have their husband and father back, John continued to fight for the compensation that would enable them to move on financially after this tragic loss.
Employed for several years in a locomotive plant, John’s client was negligently exposed to asbestos routinely, over a period of years. He was firstly exposed during the transport of items stripped out of carriages. The dismantling process was carried out in asbestos sheds but the items for disposal, such as chairs, were heavily contaminated with the asbestos dust and fibres, dust which John’s client was forced to inhale as he handled the transport of these items.
His further exposure was from the dust given off when transporting asbestos sheets from one area of the vast plant to another. As they were loaded on and off the lorries, dust and fibres were thrown up into the air, making it impossible for John’s client to avoid inhaling the dust.
No warnings were given to his client, and no masks provided to try to reduce the exposure. John was able to secure over £300,000 in mesothelioma compensation for his client’s widow and family.
