Asbestos-related disease – Mesothelioma compensation claim

Stephen was contacted by this client following the death of her husband. When he first became ill, suffering with shortness of breath and tiredness, it had been thought that he had a chest infection, and later that he was suffering from lung cancer. Following his death however, because it was known that he worked for a time with asbestos, a post mortem was carried out which confirmed that he had been suffering from the asbestos-related disease, mesothelioma.

As with many asbestos-related compensation claims, the exposure to asbestos dust had occurred many years before the onset of the disease, and Stephen had used his keen investigative skills to track down the responsible organisation and their insurers, even though the original company had long since ceased to trade.

Stephen’s client’s husband had died less than a year from the initial onset of his symptoms. He had been only in his early 60’s, his life having been cut tragically short by this fatal disease. Stephen was able to secure substantial mesothelioma compensation for his client’s loss and her husband’s suffering.

Work accident compensation claim – Slip, trip and fall injury

Stephen’s client had been injured when she slipped on liquid on the floor of the ward where she worked as an auxiliary nurse. Her duties required her to attend patients on the ward during the early hours of the morning. To avoid waking patients, she was not allowed to turn on the lights, but relied on a torch (which she had had to provide herself) when she reached the bedside.

She suffered a broken hip and although surgery was suggested, medical staff advised that the break would heal sufficiently without surgery, although she was unable to work for several months. Stephen brought this accident at work compensation claim on the basis that the NHS Trust had allowed an unsafe practice to develop and continue, breaching health and safety guidelines, and he was able to secure over £20,000 in compensation, including an interim payment, for her injuries and her loss of income during her recuperation.

Following her accident, the hospital re-instated night-lights which had been in place previously, but discontinued.

Work accident compensation claim – Manual handling injury

When this client suffered an accident at work, it accelerated a pre-existing back condition and rendered him unable to work. His employers subsequently terminated his employment.

Stephen brought this accident at work compensation claim on the basis that his employers had been negligent and breached their statutory duty to provide a safe working environment and safe equipment. He was able to secure almost £90,000 in compensation for his client’s injuries, part of which was in compensation for his future loss of earnings.

Stephen’s client had been pushing a trolley / cage fully loaded when one of the wheels collapsed around its bearing, causing it to spin around, resulting in severe jarring to his back and spine. His employer had failed to implement a safe system of inspection, which would have avoided him being provided with dangerous equipment.
