Industrial disease compensation for factory worker

As a result of exposure to excessive levels of dust and dry powder products, such as flour, this client developed occupational asthma which meant he was forced to leave his employment, with limited opportunities in the open labour market for alternative work.

Although the defendant admitted both liability for our client’s exposure, and the resulting diagnosis of occupational asthma, their insurers refused to negotiate an acceptable settlement.

Causes and risks of respiratory diseases

Coal dust, asbestos, welding fumes, and silica dust, are all known to cause or increase the risk of developing lung diseases. Employers have a duty to reduce that risk to a minimum, and wherever possible, remove the risk altogether.

Industries such as construction, shipbuilding, engineering, woodworking, mining, stonemasonry, printing and textiles, are all known to expose workers to a higher risk of exposure to potentially harmful dust and fumes.

Workers involved in industrial chemical processes have an increased risk of developing respiratory disease. Chemicals such as solvents, chlorine, ammonia and pesticides, are all known to cause respiratory diseases if workers are not adequately protected.

Employers have a duty of care to ensure employees are not exposed to substances that can foreseeably damage their health. Preventative measures such as adequate ventilation and extraction, the use of personal protective equipment, can all help reduce the risks of exposure. Where possible however, substituting chemicals known to pose a risk to workers, with others that are safer, is recommended. If this is not possible, separating the workers from the process by installing enclosed systems or cabinets will help reduce the risk of exposure.
