Medical negligence compensatioan claim - Misdiagnosis

Admitted to hospital with abdominal pain, our client was mis-diagnosed and underwent unnecessary surgery. For over six months, our client suffered severe and constant pain at the site of the surgery, and on several occasions, pieces of dressing had to be removed from the wound. Our client was eventually re-admitted for further surgery to correct the infected wound.

Kashmir found it necessary to issue court proceedings, although liability had been admitted. She was able to negotiate substantial compensation for this client, which included lost income since the original surgery, since when he had been unable to return to work.

Medical negligence compensation claim - Childbirth

What should have been a happy time became a nightmare for our client. During childbirth with her first child, the medical team failed on several occasions to notice that the baby was in distress for some hours prior to the final decision to deliver the baby by caesarean section.

The baby was immediately placed in the special care baby unit. The baby had suffered massive brain damage and survived only a few days.

Our client was severely distressed following the death of her first child and whilst no amount of money can compensate for the child, Kashmir dealt sensitively with this claim to secure compensation for her emotional and physical suffering.

Birth injury compensation claim- Birth asphyxia

Wrongly advised that a claim for medical negligence could not be made after his third birthday, a family had cared for their desperately ill son for more than 10 years. After hearing of their plight, Kashmir was able to secure almost £4m in compensation for the medical negligence which had occurred during his birth, rendering him virtually helpless.

Their son had suffered birth asphyxia which had caused a severe brain injury. He was subsequently diagnosed with cerebral palsy. The hospital admitted liability for this negligent management of his birth.

Now a young man, our client is dependent on others for all his basic needs. He is unable to walk unaided, cannot speak and has significant learning difficulties. Had he been delivered 25 minutes earlier, all of his injuries could have been avoided. Kashmir was able to settle the case against the local NHS Trust without the need to go to court.

Commenting after the successful claim, his mother said the money will help them to provide for her son’s needs. She said: “Our overwhelming concern has always been to secure our son’s long term future to enable him to develop to his full potential and to make his life as happy and fulfilled as possible. This settlement will allow us to buy a larger house which can be adapted to his needs.”
