Linda Millband - Medical negligence and asbestos solicitor

Senior personal injury compensation solicitor - Nottingham

Linda is an extremely experienced solicitor based in our Nottingham office. For over 20 years she has been working for injured people and securing personal injury compensation for the victims and their families.

Representing clients across the East Midlands, Linda’s experience during that time has been extensive and she has a depth of knowledge regarding all types of personal injury compensation claims. However, she has chosen to specialise in two particular areas of expertise and has gained a real understanding of the issues that relate to these types of cases and the impact they have on the victim’s life and their families.

The first area of expertise is in handling medical negligence compensation claims, particularly the misdiagnosis of cancer. Linda’s experience in this area has covered all types of cancer, including breast cancer and bowel cancer.

Linda knows that the key to securing medical negligence compensation for her clients is being able to demonstrate that sub-standard medical treatment caused her client’s injuries, and that their injury could have been avoided. This requires an in-depth knowledge of medical practices and procedures. Linda has a proven record of winning these types of cases, often high profile and high value claims, which stand testament to her sound knowledge of all these areas, and is reflected in the many expressions of gratitude she receives every year.

The second area of expertise for Linda is in handling asbestos-related compensation claims. Victims of these diseases may have been exposed to asbestos several decades prior to the onset of symptoms. Her experience includes winning mesothelioma compensation, and compensation for victims of asbestos-related lung cancer.

Where possible, Linda will try to conclude a compensation claim for mesothelioma within her client’s lifetime. Since the average life expectancy for a mesothelioma sufferer is typically less than a year from the date of diagnosis, Linda will work tirelessly to trace companies and insurers who may have ceased to operate, dealing with the compensation claim from beginning to end, and always treating her client and their family with sympathetic and attentive care.

Linda, a Nottingham solicitor, is one of several of our solicitors who are a member of the Law Society’s Clinical Negligence Panel. Clinical negligence is a highly specialised area of personal injury law, hence the Law Society's individual accreditation scheme for it. No other area of the personal injury legal system has its own specialist accreditation scheme and given that there are only a small number of members on the Clinical Negligence Panel, the appointments are hard fought and highly sought after.

Linda is also a member of the Law Society Personal Injury Panel, as well as having links with several support organisations, including Headway and SIA.

Successful medical negligence and asbestos-related compensation claims

Medical negligence compensation claim – Sub-standard medical treatment in hospital

Linda’s client in this medical negligence compensation claim was a young woman who was left a widow with a small child when her husband died within just a few hours of becoming ill. Although he attended hospital and was seen by medical staff, his condition was not recognised as serious until it was too late to administer procedures that could have made the difference between life and death.

The hospital admitted to her client that the care of her husband had been sub-standard and Linda was able to negotiate over a quarter of a million pounds in compensation for the loss of a husband and father. The family were obviously devastated at this tragic waste of life, but the compensation will ensure that the child will not suffer financially from his untimely death.

Asbestos-related compensation claim - mesothelioma

Linda represented this client in bringing a claim for mesothelioma compensation. Like many victims of this fatal disease, her client had been exposed to asbestos decades before the onset of the symptoms. As an apprentice and for a few years after his qualification, Linda’s client had worked on the construction and maintenance of boiler houses where asbestos was used to lag pipework.

When her client first sought medical advice for breathing difficulties, after initially being diagnosed with chest infections, he was then referred for biopsy and CT scan. Further surgery and tests diagnosed that he was suffering from pleural thickening. However, when his condition worsened he underwent more serious surgery that confirmed he was actually suffering from mesothelioma.

When Linda was asked to represent this client, she knew that the likelihood was that he had only a short time left and determined to secure mesothelioma compensation for him during his lifetime. Although she had to issue court proceedings, she was subsequently able to negotiate an acceptable settlement for her client, which at least gave him the comfort that his family would be financially secure.

Medical negligence compensation claim - Failure to diagnose breast cancer

When still only in her 30’s, this client had sought medical advice when she was concerned about a lump in her breast. For over 5 years, Linda’s client was repeatedly advised that there was no cause for concern.

Sadly, when her condition had deteriorated such that she was in constant pain and experiencing difficulty with even the simplest of day-to-day tasks, she underwent a full biopsy and bone scan that confirmed what she had feared all this time. Not only had she had breast cancer for some considerable time, but also it had spread extensively into other areas of her body.

Although she underwent radiotherapy and other treatments, Linda’s client sadly died some months before the successful outcome of her claim for medical negligence compensation, leaving a young family to grow up without her.

Linda had been forced to issue court proceedings in this case of medical negligence against the consultant general surgeon who had seen her client on many occasions over the years. Linda had been able to secure an interim payment during the course of this compensation claim and was then able to negotiate over half a million pounds in medical negligence compensation.
