Coffee shop customer compensated for injuries

Our client was a customer in a coffee shop who sustained injuries after he was hit with shards of broken crockery when plates fell off a trolley being pushed through the cafe.

At the time, our client was sitting at a table in the shop when a waitress pushed a trolley filled with plates and cutlery through the cafe and passed our client. The plates had been stacked in such a way that, when moved, they became unbalanced, falling off the trolley and smashing on the floor.

As the plates hit the floor, broken pieces flew in all directions, striking our client in the face, head and eye.

Significant Eye Injury

Our client suffered lacerations to his face and head which took two months to heal. He also sustained a significant eye injury causing him visual disturbances for three months. He required hospitalisation and was left in shock in the days following the accident.

After the accident, our client was referred to our specialist personal injury team who pursued a claim of compensation. The coffee shop initially denied liability, but eventually agreed to pay compensation for his injuries, having admitted failing to carry out a proper risk assessment and to train the waitress in basic health and safety practice.
