Compensation claim for cyclist hit in the rear by another vehicle

After cycling the same route to work for many years, our client in this road traffic accident, suffered several injuries and has been forced to find an alternative route, as he is unable to face cycling through the area where he was injured.

Our specialist road accident lawyers were forced to issue court proceedings in order to secure a successful outcome for our client. However, prior to the trial, and after advising him to reject several offers, they were able to negotiate an acceptable settlement.

Despite the defendant's insurers attempt to apportion 50% contributory negligence against our client, we were able to settle this claim for 100% in our client's favour.

Negligent driving caused cycle accident

Our client had been riding his bicycle along a main A road and around a roundabout. The defendant entered the roundabout at another junction and failed to see our client, hitting his bicycle in the rear and knocking him off.

Injuries caused by the cycle accident

Although our client did not require immediate hospital treatment, he suffered considerable injuries that caused him to visit his GP later that day. His injuries included damage to his shoulder, neck and upper back, followed later by problems with his leg and elbow as his body reacted to the trauma.

As a result of his extensive injuries, our client was unable to work for several days, and when he returned, was only able to do so with the help of colleagues who assisted him in lifting heavy items.

Although his injuries gradually resolved over different periods, he was in considerable pain for some months and found difficulty sleeping for some time. He was forced to use a car for getting to work for some time as his cycle was damaged in the road accident. However, he found this difficult and painful as a result of his multiple injuries. For some time he was unable to partake of his physical hobbies, or to carry out routine household activities.

Consequences of cycling accident

However, the biggest and most life-changing effect on our client has been to leave him nervous about returning to cycling, now taking an alternative route to avoid the roundabout where his accident occurred.
