Compensation Victory After Workplace Asbestos Exposure

A widow from Teeside has been awarded more than £140,000 in compensation after her husband Ronald died of the asbestos related cancer mesothelioma.

Mr Cater worked in the docks in Wales for Kinnis & Brown Ltd, a chemical services company. He died in June 2004 while fighting a compensation claim for his illness against them and another former employer Loriston Services Ltd.

Mr Cater's widow, Betty Cater, continued his claim however was awarded just £20,000. Mrs Cater was forced to return to work following this decision after the House of Lords changed the rules on compensation awarded to mesothelioma victims when one of the employers could not be found.

In the past it was possible to claim the full amount of compensation from the remaining employer however changes in the law in May 2006 meant that only a percentage of the compensation could be received. This meant that Mrs Cater was awarded just £20,000 out of a possible £140,000 compensation claim.

Decision Overturned

Mrs Cater appealed against the decision and The Royal Courts of Justice ruled that she should be awarded the remaining compensation.

Mrs Cater comments: "This has taken a lot of weight off my shoulders. Finally my husband can rest in peace after years of fighting for compensation. I would like to thank Thompsons Solicitors and in particular my solicitor Andrew Venn for continuing with this case and making sure that we got this good result."
