Serious head and brain injury caused by falling equipment

Our client was working on a mobile platform when a heavy piece of equipment fell from above, striking him forcefully on the head. There was no warning and he had no chance to avoid the object as it fell.

The blow caused a severe head injury and he suffered extensive brain injury. This serious accident at work has left him with ongoing conditions, including epilepsy, deafness, a poor sense of balance, and other cognitive problems.

His condition means that he will require lifetime medication to control the epilepsy, and that he will remain unemployable. He will require a significant level of daily care and, due to the medication for his epilepsy, will be unable to drive, limiting his level of independence.

Breaches of regulations result in serious work accident

Poor health and safety techniques on the part of our client’s employer had caused this serious accident at work. The accident would have been avoided had the necessary precautions been taken. The failure to implement those precautions meant that the employer was negligent and had breached several regulations, including The provisions of the Lifting Operations and Lifting Equipment Regulations 1998 (Lifting Regulations), and the Provision and Use of Work Equipment Regulations 1998 (Equipment Regulations), amongst others.

Court proceedings issued

It was necessary to issue court proceedings to bring the other sides’ insurers to the negotiating table, and although they admitted liability, several initial offers were rejected.
