Health assistant suffered chronic back injury at work

Our client, who worked as a health care assistant, suffered a neck and back injury while lifting a patient. Manual handling accident

Our client was injured during a shift at the hospital where she was asked to provide cover on a short-staffed ward and was incorrectly instructed to help lift a patient while his bed sheets were changed.

Despite repeatedly challenging the nurse’s instructions, our client followed them because she was a senior member of staff.

Due to the fact that the bed sheet had been folded incorrectly, our client was unable to slide the patient and had to pull the full weight of the patient up the bed instead.

Back injury from lifting patient

Our client suffered immediate pain in her back and neck due to the strain from lifting the patient and visited an osteopath who referred her to her GP. She has undergone intense courses of physiotherapy and acupuncture for the acute lower back pain and sciatica symptoms she suffers. Our client has difficulty sitting and standing for prolonged periods because of her injury and is being trialed for medication to relieve symptoms, which will need to be managed for the rest of her life. During her recovery she required assistance from her family and friends to carry out daily tasks.

Our client’s injury and ongoing chronic back pain have affected her ability to continue in her role as a health care assistant which involves manual lifting as well as standing for long periods. Occupational physicians have indicated that our client’s hours might have to be reduced or she be redeployed. This was accounted for when negotiating the financial settlement against the Defendant.
