Hospital worker suffers life-changing back injury after a fall

Leaving work on her usual route home, across her employer’s property, our client suffered a fall that caused her to land heavily, injuring her spine. Her injury was so severe, and subsequently proved inoperable, that it rendered her unable to even continue in her administrative role. She was forced to accept early retirement on medical grounds.

Although the defendant, her employer, admitted liability for her accident, their insurers refused to negotiate an acceptable settlement. However, before the case went to trial, and through continued strong negotiation, they were able to achieve a fair settlement for her life-changing injury.

Interim payment for back injury

Since the defendant had admitted liability, we were able to secure an interim payment whilst the case continued. This allowed some financial relief to our client, who was unable to work.

Fall at work in hazardous conditions

Leaving work after dark, our client was crossing her employer’s property as was her normal routine, when she suffered the fall that was to change her life. No lighting was provided, and in the pitch-black conditions, she did not see the hazard, and tripped, falling heavily on her knee, twisting her spine in the process.

Our client was in such immediate pain following this fall at work, that she immediately sensed that she had suffered a serious injury. She attended her local A&E where she was advised that her spine had been affected by the fall.

Although she later underwent an X-ray and an MRI scan, the results confirmed that her condition would not be improved by surgery. She continues to suffer a great deal of discomfort and inconvenience, unable to do many basic every day tasks, and many of the activities which she previously enjoyed with friends and colleagues.

Breach of Regulations

In admitting liability, her employer agreed that they had breached their duty under the provisions of the Workplace (Health, Safety and Welfare) Regulations and the Occupiers’ Liability Act.
