Skin disease compensation for latex allergy

Our client had been negligently exposed to latex on a continuous and extensive basis by her employer, who had been fully aware of our client’s diagnosed allergy to it.

Despite admitting liability, the defendant refused to negotiate an acceptable level of skin disease compensation and our specialist occupational disease lawyers were forced to issue court proceedings. However, they were able to negotiate satisfactory settlement terms before the trial and our client accepted a five-figure sum in compensation.

Exposure to latex

Some years before bringing this industrial disease compensation claim, our client had been diagnosed with latex allergy, along with other skin allergies including pollen allergy, and dog and cat allergies. At that time, her employer provided our client with nitryl vinyl gloves as a replacement when she was collecting blood.

Later, new blood packs, hand gel and cream were introduced by the service and on making enquiries, our client was advised on several occasions that there was no latex in these new packs.

However, our client began to develop extreme itching on her head, scalp, hands and legs when working with them. It was eventually confirmed that they did indeed contain latex and that she had been exposed to it on a constant and extensive basis.

Our client’s condition became sufficiently serious that her employer subsequently suspended her on medical grounds.

Breach of regulations
