Slipping Accident In Kitchen Results in Injury At Work Compensation
Our client asked for our slips trips and falls compensation claim advice on bringing an accident claim when she suffered a slip, trip and fall injury in the kitchen where she worked. Due to the layout of the kitchen, where she was standing behind a bank of equipment, she was unaware of the spillage until she slipped on the greasy floor. As a result of this injury at work, because the spillage was not cleaned up quickly enough, she suffered a soft tissue injury to her lower back. Neither were any warning signs put in place, contrary to the Workplace (Health, Safety and Welfare) Regulations.
The defendants argued that at the time of this slipping accident, they operated a system of “clean as you go” but that there had not been sufficient time between the spill and our client slipping on the grease. They also argued that there had been a verbal warning issued to our client. However, since the kitchen was a noisy area, with dishwashers operating at the time of the accident at work, it should have been obvious that a verbal warning would not be heard. Our client gave evidence that the “clean as you go” system was not enforced or adhered to. In addition, at trial, the witness for the defendants was unable to clearly recollect the time that had elapsed between the spill and our client slipping on the grease.
The judge found for our client, in that there should have been a clean-up system in place, which included immediate warnings of the spillage, possibly involving someone standing over the spillage until a mop and bucket were obtained. He also found that the verbal warning was insufficient, given the noisy environment in which our client was working.
