The claimant was an employee of the University of York. The claimant's accident occurred as he was walking over a wooden bridge.
The bridge in question had been covered in a non slip coating however there were two 150mm sections on either edge of the bridge that had not been covered.
After stepping on a section of the bridge that had not been covered the client slipped and twisted his knee.
At the trial the claimant stated that he could not be 100 per cent sure where exactly on the bridge he placed his foot but that he was walking close to the right hand side of the bridge.
The judge accepted that it was likely that the client did slip on a section of the bridge that did not have non slip coating on it therefore ruled in favour of the client.
