Road traffic accident results in life changing injuries for serving professional

A member of the country’s front line emergency services, our client in this claim for road traffic accident compensation asked for our help when his injuries affected both his work and personal life.

Our specialist road accident compensation lawyers were forced to issue court proceedings when the defendant’s insurers refused to negotiate an acceptable sum in compensation. However, through robust negotiation, they were subsequently able to secure a substantial six figure sum in compensation, avoiding the need to take the case to trial.

During the progress of this road accident compensation claim, we were able to negotiate several interim payments for our client. Some helped with the cost of recommended treatment and counselling and some were to assist his financial situation, caused directly by his injuries. These interim payments were vital in helping our client’s progression through a very difficult, traumatic period of his life.

Circumstances surrounding the road traffic accident

Responding to an emergency situation, our client, holder of an advance driving qualification, had been travelling along a major road which was virtually clear of traffic. He was aware of another vehicle waiting to pull out of a side road ahead and to his left.

As our client’s vehicle approached, the other driver began to pull out onto the main road immediately into the path of our client’s vehicle. As our client tried to avoid the other vehicle, the defendant then moved into the centre of the road and manoeuvred into position to turn immediately right, without indicating, and placing himself again into the path of our client, giving him no opportunity to avoid a collision.

Our client’s vehicle left the road and came to rest, and the other vehicle also came to rest with the passenger side hard against a wall.

Injuries caused by the road traffic accident

Initially, our client’s injuries appeared minor. He experienced dizziness and pain to his head, neck and shoulder. He also had some trauma to his wrist and knee. Although he was taken to hospital he was discharged within a few hours. However, when he did not improve, he returned to hospital and was diagnosed with a fracture to his wrist and concussion, amongst other injuries.

In addition to his physical injuries, our client began to experience significant problems with memory and would often forget conversations or where he had left items. He also suffers from panic attacks and is easily disorientated in busy or noisy places, making it difficult for him to socialise.

Consequences of road traffic injuries

Although our client was able to return to active duties a few weeks later, he continued to experience significant problems with memory and concentration. After several attempts to fit back into his working life, he was eventually retired on medical grounds.

Prior to the accident, our client had been a very confident, outgoing individual who thrived on a challenge, had a bright future and was a well-known and respected member of the community.

Since the accident he has lost that confidence, is severely disadvantaged in the labour market and lacks any self belief in himself or the future.
