Accident compensation for multiple fractures after manual handling accident

Our client in this work accident compensation claim had suffered multiple fractures to his leg when a load that he was moving on a trolley became unbalanced and fell on top of him.

The load fell onto his leg and caused fractures to his tibia and fibula, both of which required emergency surgery. As a result of this accident at work, our client has been unable to return to work and suffers depression as a direct consequence of his injuries. He has also developed arthritis and has been advised that he will require knee replacement surgery in the future.

Breach of Manual Handling Regulations

Our specialist work accident lawyers argued that the three defendants (the employers, the main contractors on site and the sub contractor who supplied our client with the trolley) had breached the Manual Handling Operations Regulations 1992 in that they had failed to correctly assess the risks in moving the load in this way.

Unbeknown to our client, the load exceeded the trolley’s maximum weight limit and had the defendants carried out a risk assessment, they would have identified a foreseeable risk to our client.

They would also have known that the road surface was uneven. As our client and a colleague moved the trolley, one of its wheels slid into a dip in the road, causing the trolley to overbalance.

Issue court proceedings

The three defendants in this work accident compensation claim refused to negotiate an acceptable settlement following our client’s manual handling injury, and we were forced to issue court proceedings.
