Mesothelioma compensation for qualified engineer in the pharmaceutical industry

Having worked across a number of industries and trades, plus a spell doing National Service, our client had been employed by this multi-national pharmaceutical company for over 30 years. He achieved a lifetime ambition to retire early and enjoy life and leisure with his wife and family.

Sadly, this was short-lived when he received the devastating diagnosis that he was suffering from mesothelioma. Negligently exposed to asbestos dust

The deceased had been employed at one of the company’s major locations, which was an old building with a large network of steam pipes insulated with asbestos. The deceased had worked alongside laggers who mixed asbestos with water before applying it to the pipes. The steam pipes constantly vibrated causing the dry asbestos lagging to flake off and contaminate the environment. The pipes also had regular maintenance work carried out on them which again disturbed the asbestos lagging.

All of these activities released asbestos dust and fibres into the air resulting in inhaling the deadly dust.

The deceased was also exposed when working on the roof of the building, which was made from corrugated asbestos sheeting. He was required to drill into the sheeting from underneath as he created fastenings for light fittings for example. This meant he was drilling the sheeting close to his face and asbestos dust would fall into his hair, face and clothes and again he would breathe this dust in.

No warnings on the danger of asbestos-related diseases

Employers had been well aware of the dangers throughout the time the deceased worked for them, and the preventative measures that the Regulations required. At no time was the deceased warned of the dangers of coming into contact with asbestos dust nor was he provided with any adequate protection.

Symptoms of mesothelioma

Like most sufferers of mesothelioma, the symptoms did not begin to develop until decades after the initial exposure had taken place. Firstly, he developed a chesty cough but a series of X-rays failed to show any problem and he was treated with anti-biotics.

A further cough was accompanied by his being extremely breathless and again he was prescribed anti-biotics. When he failed to improve, he returned and was eventually asked if he had ever worked with asbestos.

By this time, the deceased had developed a build-up of fluid in his lungs and a biopsy revealed the true cause of his condition, the fatal asbestos-related disease, mesothelioma.

Liability for mesothelioma admitted by employer
