Mesothelioma compensation after prolonged exposure to asbestos

Exposure to asbestos

Our client’s work involved loading and unloading trains at a number of different locations over a period spanning 4 decades. His exposure to asbestos took place on a daily basis in a number of different ways.

In between unloading and loading the wagons, he would be required to sweep them out ready for the next load. He was not always aware on any day what the loads contained and frequently would be sweeping up dry asbestos dust that had spilled from the sacks as they were handled.

In order to keep the trains moving, maintenance and repairs were often carried out in the goods hangar where he was working. As he went about his normal duties, he would be moving in and around fitters who were removing and repairing brake linings and brake shoes made of asbestos. This task would generate clouds of asbestos dust, which he would inhale as he moved around the hangar.

Further exposure took place when he stopped for lunch he sat alongside maintenance fitters who would have asbestos dust all over their overalls, breathing in the asbestos dust as he ate.

Protection against inhaling asbestos

During this lengthy period of exposure, when the dangers of asbestos were well known, our client was provided with no protective equipment or clothing.

At no time during his prolonged exposure was he given any warning of the known dangers of developing an asbestos-related disease, nor did he receive any training in how to minimise the risk of exposure.
