The Workplace Regulations - Slipping Accidents at Work

The client's accident happened after he went read a meter at an old people's home. In order to access the meter he had to go through a fire exit door and down a tiled corridor where the meter was situated.
On the day of the meter reading it was wet and windy and leaves had been blown into the corridor. The client slipped on the leaves as he was walking towards the meter and fell.
Workplace Regulations
The claim was fought under the Occupiers Liability Act 1957 and on the Workplace Regulations 1992.
The judge found that as there were a number of trees in close proximity to the corridor leading to the meter it was foreseeable that the corridor would have leaves blown into it.
The judge decided that leaves could be blown into the corridor within a short space of time between cleaning routines. The judge ruled that the defendant could have warned the claimant verbally of a possible danger. The defendant's failure to do this indicated a breach of the Occupiers Liability Act 1957.
