Car passenger in road accident receives compensation

We were asked for our road accident compensation claim advice by this client who was injured in a road accident on his way to work.

The defendant refused to agree to provide a voluntary interim payment whilst the medical evidence was finalised. Our specialist compensation lawyers were forced to issue court proceedings to obtain an interim payment which was then subsequently granted. However, prior to the trial their strong negotiating skills were able to secure a satisfactory settlement of £50,000 in compensation for his serious injuries.

Road accident circumstances

A passenger in the car, our client was roused from sleep when he became aware of being pulled sideways and realised the driver was attempting to overtake another vehicle. They were approaching a bend in the road, but as the car went around the bend, it sped up and he was again pulled to one side. Investigations following this road accident confirmed that the car had skidded at speed on a patch of ice.

The next thing that our client remembers was waking up and realising that the car was upside down and he was in extreme pain in his head, neck and back. Despite his considerable pain, our client was anxious to get out of the car, as he was concerned it would catch fire. He had some difficulty in getting out of the badly damaged car, but was helped by a member of the public.

Serious injuries caused by the road accident

Our client was taken to hospital where X-rays and a CT scan revealed several fractured vertebrae in his spine. He underwent emergency surgery to stabilise his injuries. To allow time for his fractures to heal he was immobilised, unable to move his upper body for several months.

His injuries had an impact upon our client's ability to work and he continued to suffer ongoing symptoms which affected his life.
