Road accident compensation for head injury victim

Head injury caused by road accident
A driver of a passenger vehicle at the time of the road accident, our client had been parked in the depot in a designated bay, at the end of his shift. There were several parking bays with vehicles passing between the lanes, though the speed limit is restricted to 10 mph.
As he alighted from his vehicle, having checked that the roadway was clear, he was struck by another vehicle, driven by a colleague. He suffered a head injury that caused him to lose consciousness. As a result of his head injury, our client remembers nothing about the road accident or the following few days. He was taken to hospital where he remained as an in-patient for several days.
Employment terminated after road accident
Following this road accident, our client was unable to return to work for several months, during which time his employer, the defendant, terminated his employment when our client was unable to provide a definite date for his return to work.
The head injury had initially caused dizziness and vertigo on a daily basis, though this improved over time. However, this head injury has left our client with some memory problems which were due to psychological factors rather than being due to the initial head injury. He was however, able to resume and continue working as a driver of a passenger vehicle again.
Issued court proceedings to secure road accident compensation
The defendant’s insurer refused to negotiate a settlement and our specialist road accident compensation lawyers were forced to issue court proceedings.
They fought this claim for road accident compensation on the grounds that the defendant had breached the Workplace (Health, Safety and Welfare) Regulations 1992, by failing to organise the workplace so that pedestrians and vehicles could circulate in a safe manner. In addition, they fought the claim on the grounds that the defendant was responsible for their employee failing to slow down, or taking avoiding action which would have prevented his vehicle striking our client.
