Road maintenance worker receives compensation for road traffic accident

Injured during the course of his work, this client asked for our help in pursuing an accident claim for road traffic accident compensation when he was injured by a negligent driver.

He had just completed a duty on traffic control at the site of road works, and was making his way to join his other colleagues when he heard a car skidding. It was raining and the road wet, but visibility was clear.

Turning towards the sound, he was struck by the defendant’s vehicle and suffered injuries to his shoulder and knees. His injuries were such that an air ambulance was summoned and he was taken immediately to hospital. He continues to suffer pain from these road accident injuries and has been unable to return to work.

Road traffic accident injuries

As a result of this avoidable road traffic accident, our client suffered a broken shoulder and leg, with additional injuries to his knees, and serious internal injuries. Admitted to hospital, he was not allowed home for several weeks but was on crutches when he did so. He has undertaken several operations since then to try to rectify the injuries, each time being allowed home on crutches and being unable to weight-bear for several months. He has also been advised that the injuries to his knees are likely to lead to knee replacement surgery within a few years.

The effects of this road traffic accident have been considerable, rendering him severely disadvantaged in the labour market. It is unlikely that he will return to his previous work, which was physical and demanding. Although improving slowly, he still suffers considerable pain at the site of these injuries and has difficulty with some basic movements like bending or kneeling.

Negligence by the defendant caused road traffic accident

The claim was brought on the basis that the defendant was negligent in that she failed to take account of the road conditions, both the weather and the fact that road works were taking place. Nor did she take notice of the traffic control that was in place to slow down traffic. The defendant had taken no notice of any of these factors and was driving too fast for any of the conditions at that time.

Detailed negotiations by our specialist personal injury lawyers were able to secure a substantial settlement in road traffic accident compensation to reflect his ongoing and future losses.
