Road maintenance worker receives compensation for road traffic accident

Injured during the course of his work, this client asked for our help in pursuing an accident claim for road traffic accident compensation when he was injured by a negligent driver.

He had just completed a duty on traffic control at the site of road works, and was making his way to join his other colleagues when he heard a car skidding. It was raining and the road wet, but visibility was clear.

Turning towards the sound, he was struck by the defendant’s vehicle and suffered injuries to his shoulder and knees. His injuries were such that an air ambulance was summoned and he was taken immediately to hospital. He has also been advised that the injuries to his knees are likely to lead to knee replacement surgery within a few years.

It is unlikely that he will return to his previous work, which was physical and demanding. Although improving slowly, he still suffers considerable pain at the site of these injuries and has difficulty with some basic movements like bending or kneeling.

The claim was brought on the basis that the defendant was negligent in that she failed to take account of the road conditions, both the weather and the fact that road works were taking place. Nor did she take notice of the traffic control that was in place to slow down traffic.
