Serious burns injuries following explosive accident at work

Our client in this claim for work accident compensation was injured when equipment on which he was working, suddenly exploded, covering him with the burning contents and steam.

With no training provided in how to carry out this particular task, he was asked to assist in what was an extremely dangerous task, the risk compounded by the fact that he was not provided with any protective clothing.

Work accident happened without warning

Our client had been working with colleagues in an attempt to unblock the equipment, which had become blocked by the contents. Whilst they were attempting to shoot water into the inspection hatches and to break down the blockage by inserting the pipes into the inspection hatches, the contents exploded out of the open inspection hatches. Our client was directly in line with one of them and his entire head and torso was covered in scalding steam and burning contents, which were known to reach temperatures of up to 120 degrees Celsius.

The area was immediately filled with steam, which hampered his attempts to escape. Unable to see due to his injuries, he eventually managed to dismount from the platform, but not without suffering further injuries to his head and teeth. He was then taken to hospital.

Worker requires resuscitation after work accident

Struggling to breathe, our client was rushed to hospital where he had to be resuscitated before being admitted to the Intensive Care Unit where he spent several days before being transferred to the burns unit.

He suffered extensive burns both externally and to his airway as a result of the steam, and continues to suffer with breathing problems.

It was many months before our client was able to return to work and when he did so, found that he was unable to carry out his previous duties. He was forced to leave the defendant’s employment to seek an alternative form of work.

Defendant admitted liability for accident at work

Following the defendant’s admission of liability for our clients injuries at work, our specialist serious injury lawyers were able to secure first an interim payment and then substantial compensation for our client, who has been forced to accept that his continued breathing difficulties as a result of his burns mean that he will be severely disadvantaged in the open labour market.

Court proceedings issued

Although the defendant admitted liability, their insurer refused to negotiate an acceptable settlement that we felt was appropriate for our client’s life-changing serious injuries. Breaches of regulations

By failing to carry out a risk assessment, they had failed to provide a safe working environment for our client who had suffered serious long-term injury as a result. A risk assessment would have clearly identified the danger of attempting to unblock the pipes in this way, or that protective clothing and equipment should have been provided.
