Serious injury following moving object accident at work
Our client’s injuries in this accident at work, had included a complex fracture to his ankle, which required several surgical procedures to correct and may still require further surgery; a soft tissue injury to the lumbar spine that took several months to resolve; and other serious injuries causing considerable pain and discomfort.
Accident at work
Our client in this accident at work compensation claim had suffered these serious injuries when he had been struck from behind by a heavy piece of equipment being moved by colleagues, and was pinned between the equipment and a steel wall.
Recovery from injury at work
Unable to return to work for almost a year, and then only able to carry out light duties, our client suffered significant loss of income. Although some of his injuries resolved within a few months, the injury to his ankle had resulted in a prolonged period in plaster and physiotherapy. The injury to his ankle continued long after his return to work and is likely to continue to cause him discomfort and lack of mobility into the future, limiting his physical abilities and rendering him at some disadvantage in the market place.
Breaches of regulations
Our specialist work accident lawyers fought this claim for work accident compensation on the grounds that the defendant had breached sections of both the Manual Handling Regulations and the The Management of Health and Safety at Work Regulations. They had failed to provide a safe working environment for our client who had suffered serious long-term injury as a result.
Court proceedings issued
Although liability was admitted by the defendant, our client’s employer, their insurers refused to negotiate an acceptable settlement. Our specialist serious injury lawyers were unable to negotiate an acceptable settlement prior to the issue of proceedings. However, before the date of the trial, they were able to negotiate almost £70,000 in work accident compensation, which had included an interim payment of £10,000 during the progress of the claim. This had gone some way to alleviate the financial impact of this serious injury on our client and his family.
