Compensation for client who slipped and fell due to breach of Occupiers’ Liability Act

Our client was visiting an underground station for the purpose of attending an interview for a position for which she had applied. She was shown into an office, which was accessed through a door that sat on a small step, some four inches above the outside floor level. When she came to leave, the interviewer opened the door for her but as she went through, she fell down the step and was injured.

The Occupiers Liability Act 1984 requires that personnel receiving visitors to their premises have a duty of care to ensure their safety whilst on their premises. The defendant argued that there had been no previous accident and there was no evident that this was a hazard.

Although the Judge found that there was a 10 per cent contributory negligence on the part of our client, given that she had already gone through the door once, he accepted that greater care should have been given to the claimant as she was a visitor and unfamiliar with the office layout. He found that a hazard sign should have been put up to alert her to the unexpected drop, or a warning given by the interviewer as he opened the door.
