The claimant suffered injury after slipping on some water that had leaked from a pump or tank underneath a fire appliance.
The defendants argued that within the fire fighting service there is a considerable amount of water. The judge however found the defendants liable on the grounds that reasonably practicable steps had not been taken to remove the water after it had leaked onto the floor.
Insufficient Training Program
According to the judge specific instructions should have been issued with regard to dealing with leakage. The judge discovered that this was a common occurrence and that in order to prevent the incident from happening some form of training or instruction was necessary.
Instead of relying on the common sense of the employees the defendants should have been proactive in dealing with the problem. Therefore they were in breach of Regulation 12 of the Workplace Regulations and also negligent at common law.
