A Low Speed Road Traffic Accident Resulted In Whiplash Injury Compensation

A whiplash injury following a road traffic accident is quite common. However, when the accident takes place whilst in slow moving traffic, it can occur without the injured party being immediately aware of the injury. One of our recent clients was in just such a situation and asked our specialist road traffic accident solicitors to represent him in his accident claim for compensation for his whiplash injury.

He was driving a works vehicle when the road traffic accident took place. Although on inspection there was no visible damage to either vehicle, our client was concerned that there may be some damage to the underside of the vehicle. He therefore asked the defendant for his insurance details as a precautionary measure.

A couple of days after the road traffic accident, our client was resting when he became aware of pain in his neck. He took a few days off work, believing it would improve. However, after several weeks he was still in pain, so he went to see his GP, who referred him for a course of physiotherapy. Several months later, he still suffered minor twinges but eventually made a total recovery.

It was necessary for our personal injury lawyers to issue Court proceedings in order to bring about a reasonable settlement. The defendant’s solicitors tried to argue that our client’s request for details at the time of the RTA indicated a premeditated intention to make an unwarranted road accident claim. However, the Judge found for our claimant and awarded £1,500 plus interest in this whiplash compensation claim.
