Rejected work accident compensation offers
Although our client’s employer, the defendant in this compensation claim, admitted liability, their insurers refused to negotiate an acceptable sum in work accident compensation. Falling objects cause work accident injuries
Our client had been moving stacked objects when a large, heavy pile fell on top of him. The stack had been made much heavier because rain had been allowed to gather in the top and the excessive weight caused the stack to become unstable. Our client slipped and fell in the wet conditions and the stack fell on top of him. Unable to release himself due to the weight, he was eventually freed by colleagues and taken to hospital in extreme pain.
When examined, he was advised that he had suffered serious injuries to both legs, one a serious fracture. Although he was initially treated at hospital, and the fracture plastered to immobilise it whilst healing, after a few weeks he was advised that neither the fracture nor his other ruptured muscle injury were healing correctly and he subsequently had to undergo extensive surgery to both legs.
Restricted life-style after work accident injuries
Only in his early forties, our client had been a very fit and active family man. His injuries rendered him almost immobile for several months and although his injuries have healed considerably, he is still in constant significant pain with limited mobility. He has been unable to resume his active sports regime and still needs support from his family for some tasks on a day to day basis.
Breach of Health and Safety at Work Regulations
Our client had suffered these serious injuries due to the breach of several regulations by his employer. These included the
The Management of Health and Safety at Work Regulations 1999
which required that adequate
risk assessments be carried to ensure the safety of employees. Had this been done, it would have identified the risk of the stack collapsing under the weight.
It would also have identified that the items were stacked above what would have been confirmed as a safe height, thus increasing the risk of them toppling over. There had also been a breach of the Manual Handling Operations Regulations 1992 which should have identified the need for manual handling training for our client and would have identified the need for equipment with which to carry out this task.
His employer’s failure to comply with these regulations had directly resulted in the serious injuries to our client.
