Anne, a Derby solicitor, is one of many of our legal representatives who have been with us for very many years. Work accident compensation claim – Strain injury
Anne represented this client in bringing a work accident compensation claim in relation to three separate injuries he received. His job involved heavy lifting and despite the first and second injuries, his employer took no steps to ensure he did not suffer further injury.
Following the last of these injuries, Anne’s client was unable to return to work. The defendant’s insurer put forward an initial offer, which Anne felt did not reflect the serious injury suffered by her client. She was subsequently able to negotiate a six-figure sum for her client in compensation for his injury and his loss of future earnings.
Asbestos-related disease claim – Pleural thickening compensation
Over 30 years after he was initially exposed to asbestos dust, Anne’s client in this claim for asbestos-related compensation had developed symptoms that included shortness of breath.
He was subsequently diagnosed as suffering from pleural thickening, though an initial concern that he also had mesothelioma proved unfounded. However, as with all cases of pleural plaque or pleural thickening, her client will now live with the risk of developing the fatal asbestos-related disease in the future.
A plumber who had been involved in removing and applying asbestos lagging to pipes and boilers, liability for his injury was admitted by the insurer and Anne was subsequently able to negotiate over £50,000 in compensation for his suffering and reduced life expectancy.
Occupational disease compensation claim – Vibration white finger
This client’s employer admitted a breach of duty following Anne’s issuing of court proceedings. They put forward a settlement proposal in respect of her client’s vibration white finger compensation claim, but this was rejected on Anne’s advice.
There was some confusion regarding causation due to other unrelated conditions, and Anne was forced to issue court proceedings. However, before the trial date, Anne was subsequently able to negotiate a sum almost three times the original sum offered, which her client was pleased to accept.
Road accident compensation claim – Motorcycle hit and run injury
Still only a minor, Anne’s client in this road accident compensation claim had been hit by a drunk driver who then proceeded to drive away from the scene, leaving her client injured on the roadside.
Her client had sustained a serious knee injury and other damage to his leg and was in plaster for several months. He needed immediate surgery and had to have further operations some months after the motorcycle accident.
When the police investigated this serious road accident, they discovered the defendant’s number plate at the scene and were able to trace him and bring a conviction. Anne was able to secure almost £30,000 in road accident compensation for her client’s injuries and loss of earnings during his recovery.
