Work accident compensation claim - Serious accident at work

This client had sustained a fracture to his leg in a serious accident at work. This left him with an injury, which is likely to require further major surgery in the future, and he is unable to return to his previous work, which involved heavy manual labour.

Although John’s client had applied for several jobs in his area, he had been unsuccessful. Given his permanent disability assessment, it is likely that he will remain disadvantaged in the labour market with little prospect of finding suitable employment.

John negotiated fiercely with the other side’s insurers and secured almost £200,000 in accident at work compensation for his client. They had originally offered a sum that John felt was not sufficient and he had been forced to issue court proceedings before they offered a realistic sum, which included some compensation for future loss of earnings.

Work accident compensation claim – Hit with moving object

This client was working on a construction site and was wearing personal protective equipment provided by his employer. Despite being highly visible, without warning he was struck by the bucket of a large mechanical digger being operated by a colleague. John’s client suffered a significant leg injury and a fractured rib. Although the rib mended in time, he has been left with some disability that renders him unable to continue in his manual occupation. His employment was subsequently terminated by the defendant.

John’s client suffered considerable pain from the day of the accident at work, and was referred to a pain clinic to try to assist him in managing this. Although this reduced the level of pain and provided some techniques to deal with the remaining pain, it was not possible to eliminate it completely.

The defendant denied liability so John was forced to issue court proceedings. However, he was subsequently able to negotiate over £100,000 in accident at work compensation for his client. This included a sum for loss of future earnings due to his reduced potential in the open labour market.
