Occupational disease compensation claim – Noise induced deafness

Vincent was able to negotiate £25,000 in occupational disease compensation for this client who suffered severe hearing loss as a result of a colleague's disregard for his client’s health and safety. Although his client’s employer admitted liability for his employee’s actions, the other side’s insurers refused to submit an acceptable offer in occupational disease compensation. Vincent was forced to issue court proceedings, but was then able to settle the claim for a sum acceptable to his client.

A maintenance engineer, Vincent’s client was working in a tunnel when another employee drove an engineering train into the tunnel and sounded a two-tone horn just a few feet from where he was standing. Given the confined space, the sound of the horn was amplified tenfold and left Vincent’s client and another colleague with their ears ringing.

Following this injury at work, Vincent’s client found it difficult to hear things clearly, and follow conversations, and he suffered dizziness and nausea. It also became clear that his reduced level of hearing prevented him passing the annual safety critical test. His client was subsequently made redundant and found that he was unable to obtain similar employment without a safety critical certificate.

Work accident compensation claim – Needlestick injury

A worker in a postal sorting depot, Vincent’s client was injured when he was sorting mail, which should already have been classified as clean, i.e. checked for harmful debris and other substances.

As he was pulling mail from the sack, he felt a sharp pain in his wrist and realised that he had been stabbed by a used syringe. Believing the mail to be “clean”, Vincent’s client had not been wearing gloves. Even had he been wearing them, they would not have protected him that far up his wrist. In addition to the immediate injury, causing pain and swelling at the site of the injury, and pins and needles in his hand, Vincent’s client also suffered anxiety and depression as he waited the many months before tests confirmed that he had not been infected by the needle.

His client was deeply affected by this needlestick injury, and felt unable to return to work in the same area, fearing further injury. His employment was eventually terminated by the defendant and he has found it difficult to find alternative, satisfying employment.

Vincent did not hesitate to issue court proceedings when the other side refused to admit liability, but prior to trial was able to negotiate a substantial sum in work accident compensation for his client.
