After instructions were received from the North East Asbestos Support and Awareness Group (NASAG), our solicitor made arrangements to visit our client at home to take a full proof of his evidence and discuss the claim with him in some detail. A claim was then made to a construction company for which our client had worked and investigations into the value of the claim were made. A medical report was obtained and then an offer was made to settle the claim.
At this time, the claim suffered slightly from the delay incurred obtaining instructions from the client, as he moved to Spain for the winter (as he does every year). As we received no satisfactory response to the offer, court proceedings were started, at which point the defendant instructed solicitors. Settlement negotiations began and ultimately, the claim was settled less than nine months after instructions were received.
The North East Asbestos Support and Awareness Group had already assisted the client in making an application for a payment under the 1979 Act, which resulted in an award being made. His claim was settled for a six-figure sum.
