Road accident compensation claim – Pedestrian accident
This client asked Emma to represent him in bringing a road accident compensation claim when he was injured by being hit by a motorcyclist. Her client was a pedestrian and was hit by the motorcycle and sustained a broken leg and several other injuries to his lower limbs, as well as broken ribs and extensive bruising.
Even though the motorcyclist was uninsured his claim was successfully pursued through the Motor Insurer’s Bureau.
Emma was forced to issue court proceedings. However, before the trial date, she was able to negotiate an acceptable settlement and her client accepted an offer of over £30,000 in compensation for his injuries and continuing pain. It also includes a sum for loss of income during his extended recuperation, which included several weeks in hospital.
Road accident compensation claim – accident involving emergency vehicle
A member of the emergency services, Emma’s client in this road accident compensation claim had been travelling in the rear of an emergency vehicle. The vehicle braked sharply and then collided with another vehicle, causing her client to be thrown around the vehicle, colliding with several objects that caused him injury.
Taken to his local A&E, he underwent several x-rays of his back and neck and was prescribed extremely strong painkillers. Although surgery was not required, Emma’s client was suffering considerable pain due to his injuries and for over six months was forced to rely on his wife for almost all personal and domestic tasks. Although he eventually returned to the job he had done for many years, and which he loved, he was eventually retired on medical grounds.
Court proceedings were issued but before the trial date, Emma was able to negotiate in excess of £100,000 in road accident compensation for her client.
Road accident compensation claim – defendant was employer of driver
Emma was asked for her road accident claim advice by this client when he received whiplash injuries in a road accident through no fault of his own. He had been stationary in his car when, without warning, his vehicle was struck from behind by another vehicle, being driven by an employee of the defendant.
As a result of the violent collision, Emma’s client was tossed around in his seat and suffered significant whiplash injuries which caused him considerable pain and discomfort. He was unable to work for several weeks, only able to return because his employer was able to provide light duties. However, he subsequently suffered further problems as a result of the road accident and required further time off work.
Because the vehicle was being driven in a commercial situation, the defendant in this road accident compensation claim was the owner of the vehicle, rather than the driver themselves.
Although the defendant admitted liability for her client’s accident, Emma believed the offers put forward were not reasonable, given her client’s ongoing condition. She was forced to issue court proceedings but before the trial was able to negotiate a substantially increased sum in road accident compensation for her client.
