Here is just a small sample of the successful road accident compensation claims Helen has won.
Road accident compensation claim – Motorcycle accident
Helen was able to secure £200,000 accident compensation for this client when his injuries meant he could not return to work in his chosen profession (loss of congenial employment). Her client had been riding his motorbike home from work when the defendant, who was driving towards him on the other side of the road, suddenly turned right in front of him, leaving him no opportunity to avoid the collision.
Part of the accident compensation sum was for loss of future earnings. Even if he were able to secure work, it was likely to be at a substantially lower rate of pay. As a result of his retirement on ill-health grounds, Helen’s client was also unable to continue in his employer’s pension scheme, so some of the sum was also in recognition of this financial loss.
Although liability had been admitted by the defendant, Helen was forced to issue court proceedings before the defendant’s insurers made an acceptable offer of accident compensation. However, before the trial date, Helen was able to negotiate a significantly increased sum from that originally offered.
Road accident compensation claim – Passenger in a taxi
Helen was asked to represent this client following his road accident during the course of his work. He was travelling as a passenger in a taxi that had been engaged by his employer to transport him from one location to another.
The taxi had been hit by another vehicle approaching from a side road who had failed to give way. Helen’s client was trapped inside the taxi for some time and was taken to hospital when eventually freed. His injuries were extensive, including a broken pelvis, broken leg and a knee injury.
Although he is expected to make a reasonable recovery, and he was able to return to work in his chosen profession, due to the physical requirements of his job we had to make provision for the possibility that he may have difficulty in the future carrying out the manual elements of the role.
Liability was admitted by the defendant, but the other side’s insurers refused to offer an acceptable sum in accident compensation. Helen was able to negotiate an acceptable settlement after issuing court proceedings.
