One common area where an obvious failure to show care is assumed is where one car collides with the rear of another - the so-called "rear end shunt", where frequently, whiplash injury results.

What to do if you are involved in a road traffic accident

If any injury occurs as a result of a road traffic accident, the police should, if possible, be called. They will compile a report which is of considerable importance in any subsequent legal action. We can obtain that for you and report on the contents and how they affect your accident claim.

In some cases it may be possible to sue the highways authority, or Highways Agency. For example if a vehicle slips on ice or snow, there may be liability on the authority if it has failed to take proper steps such as gritting the road, under S.41 of the Highways Act 1980, as changed at law in 2003.

If a road accident happens, wherever possible always keep a record and take photographs if you can; take the names and home addresses of witnesses; keep evidence of doctors visited and treatments, and keep receipts for any injury related expenses.

Try and keep a rough diary of the time family and friends are taking to care for you each day or helping out by doing the chores you used to do - money can be claimed for all this time.

"Non existent" whiplash said insurers: the Judge did not agree

In 2005 we won a fiercely contested case at Manchester County Court where the defendant denied any damage could have been done in a low speed accident and brought engineering expert evidence to try to prove that point.

The engineering expert for the insurer in this case was an expert whose work had been commended by the Court of Appeal in a similar case.

The Judge accepted our submissions that we could prove that it was perfectly possible - contrary to his evidence - that an accident that may have occurred at two to five miles per hour could still do some damage.

We had made many reasonable offers to settle the case and the Judge penalised the insurers and rewarded the Claimant by adding extra penalty interest to her damages and legal costs.

This case was run from our Manchester office against an insurer who has defended similar claims before.

Such an approach has been taken by insurers across the country to perfectly legitimate claims and dismissed even in the Court of Appeal in favour of crediting honest injured parties.

Successful road accident claim for head-on crash
