Road traffic accident compensation– Motorcycle injury
Alastair successfully fought a claim for this client when he suffered serious leg injuries as the result of a motorcycle accident. His client was navigating a roundabout when the defendant pulled out at speed and collided with his motorcycle.
Despite wearing a crash helmet and appropriate protective clothing, Alastair’s client suffered a serious compound fracture of his leg, and dental injuries as a result of head trauma.
In addition to his physical injuries, which caused him to be hospitalised for several days, Alastair’s client suffered from flashbacks, panic attacks, and sleep disturbance. Although his physical injuries eventually improved following several sessions of physiotherapy, Alastair’s client was unable to return to his engineering post and was forced to take early retirement.
The defendant admitted liability but the insurers refused to negotiate an acceptable settlement for the client’s injuries. Although obtaining several interim payments, Alastair was forced to issue court proceedings and advised his client to reject several unsatisfactory offers. However, before the trial date Alastair was able to negotiate an excellent six-figure sum in compensation for his client’s injuries .
Work accident compensation – Personal protective equipment
A self-employed worker was asked by the defendant to repair a construction vehicle. He was provided with safety glasses but there was a gap between the bottom of the lens and his face. Alastair’s client used a hammer to try to remove a retaining pin but as he did so, he felt a sharp pain in his eye.
Alastair’s client has been left with permanently reduced vision, which means that he is unable to see sufficiently to return to his previous type of work. He has been advised that he has a small risk of developing related diseases that could lead to blindness.
Alastair fought this claim on the grounds that the defendant has breached sections of the PUWER (Provision and Use of Work Equipment Regulations) and PPE (Personal Protective Equipment) Regulations. Initially liability was denied by the defendant but Alastair fought to eventually secure a six-figure sum in compensation for his client’s injuries and future loss of earnings.
