Work accident compensation claim – Catastrophic injury resulting in paralysis
Andrew represented this client following his tragic accident at work. In the manufacturing plant where his client worked, unsafe practices had been allowed to continue during the unloading of large and heavy objects, often weighing up to 2 tonne.
As he went to assist the unloading, Andrew’s client slipped and lost his balance, fell forward and was crushed .
He was immediately taken by ambulance to hospital. It was quickly confirmed that the main impact was to the back of his neck, flexing his head and neck forwards. This resulted in a spinal cord injury that is complete and has left Andrew’s client permanently paralysed. He is now completely dependent upon care around the clock for the rest of his life.
Andrew was forced to issue court proceedings when the defendant refused to accept full liability for his client’s injuries. However prior to the trial date, they conceded and Andrew began the task of assessing the sum of compensation that would be required to care for his client for the rest of his life.
Initially Andrew was able to secure in excess of one million pounds in interim payments, which allowed his client to purchase suitable accommodation for his needs. Further strong negotiating on Andrew’s part secured annual payments for the ongoing care that his client will need, a sum which will exceed £10 million should his client live a normal life expectancy.
Throughout this serious injury compensation claim, Andrew was heavily involved in the setting up of his client’s care and accommodation package, and was determined to secure the compensation that his client both needed and deserved.
