Here are just a few of the successful accident compensation claims which Mark has handled.
Work accident compensation claim – Serious injuries
Mark represented this client, who was only in his 20’s at the time of his accident at work, in bringing a claim for work accident compensation. His client worked in the construction industry and was a respected employee and colleague.
On the day of the work accident, Mark’s client was knocked down by an excavator which was travelling along railway lines. He was pushed for some distance, sustaining multiple injuries which were so serious that he will not work again.
His injuries included fractures to vertebrae and significant soft tissue injuries to the lower lumbar spine. He also suffered internal injuries causing conditions which are progressive and irreversible. As a result Mark’s client will suffer permanent chronic pain. His internal injuries mean that he will require life-long pain management and he has been advised that it may be necessary to undergo surgery in the future.
The defendants admitted liability but Mark was forced to issue court proceedings to ensure he secured the maximum compensation that his client would require, both for his on-going care, and the loss of congenial employment. After securing several interim payments to help alleviate his client’s financial difficulties during the progress of his claim for accident compensation, prior to the trial date, Mark was able to negotiate a settlement in excess of £1 million pounds.
Accident compensation claim – Occupier’s liability
Mark’s client in this claim, brought under a breach of the Occupiers' Liability Act 1957, was injured when she fell down the stairs at a private house. She had been staying at the property overnight and needed to go down the stairs during the night.
She was unable to find the light switch either at the top of the stairs as she descended, or at the bottom before she went up again to return to the bedroom. She had almost reached the top when she found herself falling backwards down the stairs. There was no bannister fitted on the outside of the stairs so Mark’s client was unable to prevent her fall and she landed on the floor on her back.
Investigations at hospital confirmed that she had suffered a fracture of a vertebra plus another spinal cord injury, and broken ribs. His client has been left a paraplegic and will be confined to a wheelchair for the rest of her life.
Mark brought this claim for accident compensation on the grounds that the owner of the property had breached the Occupier’s Liability Act by failing to construct the stairs in a safe and proper condition . Although the defendants strongly contested liability, Mark was able to secure a significant six figure sum for his client.
Accident compensation claim – Sports injury claim
Mark secured a significant sum in accident compensation when this client suffered a sports injury. The initial injury had resulted in a severe fracture of her knee which was treated in her local hospital. However, after several days, doctors discovered that there had been severe damage to her blood vessels and she later had to have her leg amputated below the knee.
His client’s injury had occurred during a trampoline class at her local sports centre. Although it was her first visit, she was asked to carry out a complicated routine, from which she landed awkwardly causing the fracture to her knee.
Mark brought this claim for sports accident compensation claim against the sports centre. They denied liability and Mark began steps to issue court proceedings. However, before this took place, the defendants offered to settle the case. Mark felt the sum offered was far short of a reasonable sum for compensation for her injuries. After rejecting this initial offer, the defendant made an increased offer of more than double their initial one, and Mark’s client accepted.
