Successful accident compensation claims

Here are just a couple of examples of the many clients who have suffered serious injury and for whom Samantha has secured substantial compensation.

Work accident compensation claim – Severe burn injuries

Samantha represented this client when he suffered 65% burns. His injuries were so severe that he was put into a medically induced coma in order to minimise his immediate suffering. He subsequently underwent more than 20 reconstruction operations and is still receiving skin grafts some years after the accident at work. His legs were so badly damaged that amputation was considered. Thankfully, an eight-hour operation was carried out and surgeons were able to save them.

These devastating injuries were caused when molten iron spilled onto the platform on which our client was standing. He was engulfed in heat, steam and smoke. Blinded by the steam and smoke, he was unable to escape because the aluminium access ladder to the platform he was on had melted in the heat.

He is unable to return to work in the foundry due to the psychological effects of his traumatic accident, and the flashbacks that he still experiences. Physically however, he has made an excellent recovery and is expected to be able to return to employment. He is now coming to terms with the scars that he will bear for the rest of his life.

The client’s employer denied liability for his accident. Samantha argued that the work equipment was faulty and that the system of work was inherently unsafe. She was able to secure an out of court settlement of substantial work accident compensation.

Work accident compensation claim – Fall from height

Samantha’s client in this work accident compensation claim, was only in his 20’s at the time of his accident. A scaffolder, he had fallen 20 feet when a platform on which he was standing collapsed. The platform was erected by foreign contractors. It was intended to support up to a tonne in weight. Unfortunately, it had been erected with the incorrect bolts and was unable to sustain even the weight of Samantha's client.

Her client suffered catastrophic injuries. His family were initially advised that he was unlikely to survive. Thankfully, he did survive and made remarkable improvements. However, he suffered a brain injury of the most sever kind. It affected his ability to walk, talk and use his limbs. Several years on, he is now able to walk with assistance from two support workers, he can talk but requires on-going and extensive speech and language therapy, he has some limited use of his upper limbs. He will always need 24 hour care from a team of support workers, never being able to live independently.

Samantha was able to secure several interim payments throughout the course of this serious injury compensation claim. As is typical with such serious injuries, a claim can take several years to conclude, allowing sufficient time for the long-term prognosis to be finalised. During the case interim payments were recovered allowing her client to secure a specially adapted bungalow with hydro-therapy pool, and the 24-hour care that he needed.

The final sum in work accident compensation was substantial and will ensure that her client’s needs can be provided for, for the rest of his life. The claim settled shortly before Trial.
