Animal attack compensation claim – Dogbite injury
A postal worker, Ranjit’s client in this claim for animal attack compensation was attacked when trying to deliver an item to the dog’s owner. Having knocked on the front door, the owner opened it and the dog ran past him and attacked Ranjit’s client.
It was a large dog and it succeeded in biting her in several places, including her wrist and thigh. She was unable to continue her round and attended hospital where her injuries were treated and she was given a course of antibiotics. She has been left with significant bite wounds following this animal attack, and was unable to carry or lift anything with her injured hand for some time.
Prior to this animal attack, the dog’s aggressive behaviour was well known to the owner, his neighbours and other postal workers. Despite previous incidents, the owner had failed to control his dog. Ranjit successfully won personal injury compensation for his client under the Animals Act 1971 on the grounds that the owner had failed to restrain the animal before opening his front door to a member of the public, which would have prevented this animal attack.
Work accident compensation claim – Slipping accident at work
This client suffered a fracture to the scaphoid bone in her hand when she slipped and fell at work. She also continued to suffer from chronic pain at the site of the fracture.
Some floors around the workplace were being stripped and repolished at the time of her accident at work. However, in the area where she slipped, there had been no warning signs and the area had not been cordoned off. She had been wearing flat loafer shoes with a rubber sole.
There had been several complaints about the floors, and several near miss incident reports completed. However, her employer had failed to take action following these incidents and failed to provide and / or maintain a safe means of access to her place of work.
Ranjit was able to secure substantial slip, trip and fall compensation for his client, though not before he was forced to issue court proceedings when the other side’s insurers refused to negotiate an acceptable sum in compensation.
Work accident compensation claim – Fall from height
Ranjit’s client suffered several serious fractures when a set of steps collapsed from beneath him. A painter, he needed the steps to reach the area which needed painting. He set up the steps and made sure they were secure. He had climbed up and down them several times when they collapsed beneath him, causing him to fall several feet to land awkwardly on top of them. He suffered a fractured heel, ankle and elbow in this accident at work and was unable to return to work for some time.
Immediately after the accident, the steps were removed, but not before he was able to see that the brace / locking mechanism was broken and swinging loose.
Ranjit was able to negotiate a substantial sum in work accident compensation for his client on the grounds that the steps were faulty. His employer had failed to provide his client with a safe system of work and safe work equipment. These failings were a breach of the Provision and Use of Work Equipment Regulations 1998.
