Work accident compensation– Slip, trip and fall

Jane’s client was an engineer and his work required him to visit construction sites routinely. On one such visit, he suffered a broken ankle because the site owner had failed to put in place safe access routes around the site. As he stepped down from a plinth onto uneven ground, he slipped and went over on his ankle.

The client attended A&E where it was confirmed by x-ray that he had sustained a fracture. He was unable to work for several months and needed physiotherapy to complete his recovery.

Jane won this case on the grounds that the site owner had breached Regulations by virtue of their failure to provide a safe working environment. Jane was forced to issue court proceedings when the other side’s insurers refused to negotiate a settlement. However, shortly before trial Jane was able to negotiate an acceptable settlement for her client.

Work accident compensation– Slip, trip and fall

This client was attempting to clear sensors on a conveyor that had become blocked. Using a sweeping brush, in accordance with accepted procedures, he had climbed a set of ladders that were fastened to the conveyor. As he descended the ladders, holding the broom, he slipped on the accumulation of grease and dirt on the rungs and fell, sliding down the ladder rail.

He suffered fractures to his ribs and vertebrae, as well as injury to his lumbar spine. He was in considerable pain and was unable to return to his previous job, which included heavy manual work.

This was yet another case where the negligence of the employer resulted in an accident at work through their failure to comply with Regulations. Jane was forced to issue court proceedings but was able to negotiate substantial compensation for her client, which contained a sum in recognition of his on-going disadvantage in the open labour market.

Work accident compensation– Negligence by a colleague

This client suffered a laceration to the back of her ankle when she was struck from behind by a hoist being manoeuvred by a colleague. Although it did not appear to be too serious initially, the wound became ulcerated and was excruciatingly painful, requiring strong pain relief.

Jane’s client eventually recovered sufficiently to return to work but found she was limited to the amount of time she could work without the injury causing her discomfort.

Jane entered into detailed negotiations and correspondence with the defendant and was able to negotiate a satisfactory settlement in accident at work compensation.
